By using Atheer, you agree to use our AI hiring tools responsibly and in compliance with applicable employment and data protection laws. Atheer's AI assists your hiring process — final decisions remain with you. You own your data; we process it only to deliver the Services. Disputes are governed by Saudi Arabian law.
1. Acceptance of Terms
By accessing or using the Atheer platform, website, or any related services (collectively, the "Services") provided by Atheer Technologies ("Atheer", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms").
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include both you individually and that organization.
If you do not agree to these Terms, you must not access or use our Services.
2. Description of Services
Atheer provides an AI-powered Hiring Operating System designed for organizations in the GCC region. Our Services include:
- AI-driven candidate screening and CV analysis
- Automated and live AI interview tools with voice and video capabilities
- Role-specific technical and behavioral assessments
- Candidate scoring, ranking, and shortlisting
- Hiring analytics and reporting dashboards
- Workflow automation for recruitment pipelines
- Arabic and English language support throughout
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice to active customers.
3. Account Registration
To access certain features of our Services, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You must be at least 18 years of age to create an account. Accounts are non-transferable without prior written consent from Atheer.
4. Subscription Plans and Payment
Subscription Plans
Atheer offers various subscription tiers with different feature sets and usage limits. The specific features, pricing, and limitations of each plan are described on our pricing page and in your order agreement.
Payment Terms
Subscription fees are billed in advance on a monthly or annual basis, as selected at the time of purchase. All fees are non-refundable except as expressly set forth in these Terms or required by applicable law.
Price Changes
We reserve the right to modify pricing with 30 days' advance notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.
Taxes
You are responsible for all applicable taxes, including VAT as required under Saudi Arabian and UAE regulations.
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services in any way that violates applicable laws or regulations in Saudi Arabia, the UAE, or any other jurisdiction
- Upload or transmit fraudulent, misleading, or discriminatory candidate data
- Attempt to circumvent or manipulate our AI scoring or assessment systems
- Use the Services to make hiring decisions based solely on protected characteristics including race, gender, religion, nationality, age, or disability
- Reverse engineer, decompile, or attempt to extract the source code of our platform
- Share your account credentials with unauthorized third parties
- Use automated tools to scrape, crawl, or extract data from our platform
- Upload malicious code, viruses, or any software intended to damage or disrupt the Services
- Violate the privacy or rights of candidates, employees, or other users
6. Candidate Data and Employer Responsibilities
Employer as Data Controller
When you use Atheer to process candidate data, you act as the data controller and Atheer acts as the data processor. You are responsible for ensuring that:
- You have a lawful basis for collecting and processing candidate personal data
- Candidates have been informed about the use of AI-powered tools in the hiring process
- Your use of Atheer's AI assessments complies with applicable employment laws in your jurisdiction
- You do not make final hiring decisions based solely on automated outputs without human review
Data Accuracy
You are responsible for the accuracy and completeness of data you upload or enter into the platform.
Compliance
You agree to comply with all applicable data protection laws, including Saudi Arabia's Personal Data Protection Law (PDPL), UAE data protection regulations, and where applicable, the EU General Data Protection Regulation (GDPR).
7. Intellectual Property
Atheer's Intellectual Property
The Services, including all software, algorithms, AI models, designs, text, graphics, and other content, are owned by Atheer Technologies and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Services.
License to Use
Subject to your compliance with these Terms and payment of applicable fees, Atheer grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes.
Your Content
You retain ownership of all data, content, and materials you upload to the platform ("Your Content"). By uploading Your Content, you grant Atheer a limited license to process and use it solely to provide the Services to you.
Feedback
Any feedback, suggestions, or ideas you provide about the Services may be used by Atheer without restriction or compensation to you.
8. AI and Automated Systems Disclaimer
Atheer's AI systems are designed to assist, not replace, human judgment in hiring decisions. You acknowledge and agree that:
- AI-generated scores, rankings, and recommendations are probabilistic outputs and not guaranteed to be accurate
- Final hiring decisions must involve human review and judgment
- Atheer does not guarantee that use of the Services will result in successful hires or improved hiring outcomes
- You remain solely responsible for all hiring decisions made using or informed by the Services
- AI models may reflect patterns in historical data and we recommend regular review of outputs for fairness and bias
9. Confidentiality
Each party agrees to maintain the confidentiality of the other party's non-public information disclosed in connection with the Services ("Confidential Information"). Confidential Information does not include information that:
- Is or becomes publicly available through no fault of the receiving party
- Was rightfully known to the receiving party before disclosure
- Is independently developed by the receiving party without use of the disclosing party's information
- Is required to be disclosed by law or court order
Confidentiality obligations survive termination of these Terms for a period of three years.
10. Warranties and Disclaimers
Atheer's Warranties
Atheer warrants that the Services will perform materially as described in our documentation, and that we will implement reasonable security measures to protect your data.
Disclaimer
EXCEPT AS EXPRESSLY SET FORTH ABOVE, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ATHEER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATHEER'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE FEES PAID BY YOU TO ATHEER IN THE TWELVE MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL ATHEER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Atheer Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- Your use of the Services in violation of these Terms
- Your violation of any applicable law or regulation
- Your processing of candidate data in violation of applicable data protection laws
- Any hiring decisions made using or informed by the Services
13. Term and Termination
Term
These Terms remain in effect for the duration of your subscription or use of the Services.
Termination by You
You may terminate your account at any time by contacting info@aiatheer.com. Termination does not entitle you to a refund of prepaid fees.
Termination by Atheer
We may suspend or terminate your access to the Services immediately if you breach these Terms, fail to pay applicable fees, or engage in conduct that we determine, in our sole discretion, is harmful to the Services or other users.
Effect of Termination
Upon termination, your license to use the Services ends. We will delete your data in accordance with our data retention policy as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in Riyadh, Saudi Arabia, in accordance with applicable arbitration rules.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or prominent notice on our platform.
Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services and may terminate your account.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and any applicable order agreements, constitute the entire agreement between you and Atheer regarding the Services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. Atheer may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure: Atheer shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control.
